Terms of Use

1. Operator and acceptance

Escale is operated by Alexandre Grisey, a French sole proprietorship registered under SIRET number 83978643100024, at 7 Allée de Chartres, 33000 Bordeaux, France (“Escale”, “we”, “us”).

By downloading, installing, purchasing, activating, or using Escale, you agree to these Terms. If you use Escale for an organisation, you confirm that you are authorised to accept these Terms for it. If you do not agree, do not use Escale Pro; you may still exercise any rights granted directly by the open-source licence for Community source code.

2. What Escale does

Escale is a native macOS workspace for managing information and actions across App Store Connect and Google Play. It can read, prepare, and—with your explicit action—write store metadata, screenshots, prices, releases, review replies, and other supported data through official APIs. Optional AI features send selected content directly to OpenAI using an API key you provide.

Escale is independent and is not affiliated with or endorsed by Apple, Google, OpenAI, Polar, GitHub, or PostHog.

3. Community and Pro

Community edition

Community is free to use without an Escale account or time limit. Source code identified as Apache-2.0 licensed in the public repository is governed by that licence, which controls if it conflicts with these Terms. The Apache licence continues to govern Community code included in an official distribution. The Escale name, logo, website, support, signing services, and update infrastructure are separate from those source-code rights.

Pro licence

Escale Pro is the official signed and notarized distribution. An active subscription provides one named user on up to two Macs with licence management, verified in-app updates, maintained workflow conveniences, release operations, and support. It does not relicense or reduce your Apache-2.0 rights in incorporated Community code.

When a subscription ends, is refunded, charged back, or validly revoked, access to subscription services and maintained commercial workflows may end. Your local workspace and Community rights remain available.

4. Purchases, renewals, and Polar

Polar Software, Inc. is the merchant of record and authorised reseller for new Escale Pro purchases. You purchase through Polar, while Alexandre Grisey licenses the Escale software to you under these Terms. The checkout is also governed by the Polar Buyer Terms and Polar Privacy Policy.

The checkout shows the current price, currency, applicable taxes, billing period, and any discount before payment. Yearly subscriptions renew automatically until cancelled. You may cancel from Polar’s customer portal; cancellation normally takes effect at the end of the paid billing period, and Pro remains available until then. Cancelling does not itself refund an elapsed or current paid period.

You are responsible for keeping billing information current and for any taxes or reporting obligations that legally remain yours. Polar handles checkout collection, invoices, and transaction taxes in its role as merchant of record.

5. Refunds and withdrawal rights

Escale offers a voluntary 14-day refund window for the original Pro purchase and subscription renewals. Send the request to pro@alexandre-grisey.fr or use Polar’s support or customer portal, identifying the order and purchase email. Approved refunds are processed through Polar. A full refund normally revokes the corresponding Pro licence or paid period.

This policy does not limit mandatory statutory rights. If you are an EU or other protected consumer and a statutory withdrawal right applies, you may exercise it by sending an unequivocal request within the legal period. Because Pro access is digital and may begin immediately, any loss of a statutory withdrawal right applies only where all legal conditions—including any required express request and acknowledgement at checkout—have been satisfied.

6. Your accounts, credentials, and responsibilities

You are responsible for:

• having authority to access every Apple, Google, and OpenAI account connected to Escale;
• using least-privilege credentials and protecting your Mac, licence key, private keys, and account access;
• complying with the terms, policies, permissions, and laws applicable to each connected service and app;
• reviewing edits and consequential actions before sending them;
• maintaining appropriate backups or copies of important store data; and
• verifying important results in the official store console.

Do not share a Pro licence key outside its licensed user, exceed its device limit, bypass or interfere with licence and update services, use Escale unlawfully, share access to subscription services, or present an unofficial build as signed or supported by Escale. These restrictions do not reduce rights expressly granted by an applicable open-source licence or mandatory law.

7. AI-assisted output

AI-generated translations and other optional AI output may be inaccurate, incomplete, or inappropriate. You must review them before use. You are responsible for the content you submit to OpenAI, for complying with OpenAI’s terms, and for charges to your OpenAI account. Do not send personal, confidential, or regulated information unless you have a lawful basis and are comfortable with the provider’s processing terms.

8. Updates, compatibility, and availability

Escale currently requires an Apple silicon Mac running macOS 14 or newer. Apple, Google, OpenAI, Polar, or operating-system API changes may affect features without notice. We may change, add, remove, suspend, or discontinue features when reasonably necessary for security, compatibility, legal compliance, or product development.

We aim to provide reliable signed updates and reasonable support but do not promise uninterrupted availability, a particular feature forever, or compatibility with every third-party API change. Material changes to a paid offering will not reduce rights that mandatory law gives you.

9. Intellectual property and feedback

Community source remains governed by Apache-2.0, and third-party materials remain governed by their own licences. The Escale website, original design and documentation, branding, signing and update infrastructure, support materials, and related services are owned or operated by Alexandre Grisey and protected by applicable law.

If you voluntarily submit feedback, you allow us to use it without restriction or payment to improve and promote Escale, provided we do not publicly identify you without permission. You retain ownership of your store content and other materials.

10. Warranties and liability

Escale is a developer tool capable of consequential remote changes. To the maximum extent permitted by law, it is provided “as is” and “as available,” without promises that it will be error-free or suitable for every workflow. There is no automatic rollback.

Nothing in these Terms excludes liability or a warranty that cannot legally be excluded, including mandatory consumer conformity rights, liability for fraud, wilful misconduct, gross negligence, death, or personal injury where applicable. For users acting for professional purposes, and only to the extent permitted by law, our aggregate liability arising from Pro is limited to the amount paid for Escale Pro during the 12 months before the event giving rise to the claim, and we are not liable for indirect loss, lost profit, lost opportunity, or third-party platform outages.

11. Suspension and termination

You may stop using Escale at any time and cancel Pro through Polar. We may suspend or terminate Pro access for material breach, licence abuse, fraud, chargeback, unlawful use, security risk, or payment failure, providing notice and a reasonable opportunity to cure where appropriate. Pro access may be suspended immediately where necessary to prevent harm or comply with law.

Pro licence restrictions, intellectual-property provisions, accrued payment obligations, warranty and liability provisions, and dispute terms survive termination where their nature requires it.

12. Governing law and disputes

These Terms are governed by French law, without depriving a consumer of mandatory protections available under the law of their country of residence. Please contact pro@alexandre-grisey.fr first so we can try to resolve a dispute informally.

Purchase, payment, tax, and checkout disputes may also be governed by the Polar Buyer Terms because Polar is the merchant of record. Consumers retain access to any competent consumer authority, mediation procedure, or court available under mandatory law. For disputes between professionals, the competent courts of Bordeaux, France have exclusive jurisdiction to the extent permitted by law.

13. Changes to these Terms

We may update these Terms for legal, security, provider, or product changes. The updated date will appear above. Material changes affecting an active paid subscription will be communicated reasonably in advance where required, and will apply prospectively. If you do not accept a material change, you may stop using Escale and cancel renewal before it takes effect.
